CONDITIONS OF BUSINESS for GOLF CRUISE PROGRAMS
(Effective April 28, 2022)

Conditions & General Information: The conditions below form the basis of any contract between you and PerryGolf (the Company). When you contact the Company to book your tour, you appoint them to act as your agent to obtain the requested services for you. When they have done so, and you have confirmed the booking and paid the deposit, they will accept responsibility for providing your vacation from that point onwards. No employee or representative of the Company has the authority to change these conditions or information.

Deposit & Final Payment: Schedules of deposit and final payment vary by program, and are as detailed in the reservations material of the applicable program.

Cancellation: Notification of cancellation by a client must be forwarded in writing to PerryGolf. Cancellation charges vary dependent on the travel package purchased. The schedule of cancellation charges for various packages is listed on your reservation form. No refund will be made for unused portions of a travel package.

Documentation: For US citizens, a current passport is required for overseas travel. Regardless of your nationality or residency, you are responsible for ensuring you have the required documentation for travel to your intended destination.

Responsibility: PerryGolf, as the tour operator, and its selling agents, act only as agents in securing and booking the hotel accommodations and other land tour services provided as others as independent contractors. PerryGolf, its selling agents or the specified air carriers assume and accept no liability for injury, loss, damage, accident. delay, changes or inconvenience caused by: any force majeure - health risks including epidemics – enforced travel restrictions - reason of war or threat of war – riots - civil strife - terrorist activity - industrial disputes – acts, omission, neglect, delay or default of any person engaged in providing any tour services including transportation and accommodation - technical problems to transport - closure or congestion of airports or ports - building work - extended hotel closure - cancellations or changes of schedules by airlines - interruption or failure of public utilities outside the control of the hotel and similar events beyond our control, including storms, tempests and hurricanes. If any tour service or its reasonable equivalent is not provided due to events beyond the reasonable control of PerryGolf, the company will make an appropriate refund of that portion of the tour price covering the undelivered tour service, but it is understood that PerryGolf shall have no other or further responsibility or liability either for the accuracy of any representation or the non-provision of any tour services.

Loss, Damage or Theft: PerryGolf is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness on any vehicle or at any place throughout the tour.PerryGolf is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness on any vehicle or at any place throughout the tour.

Golf Courses: The included list may be subject to change in the event of any club accepting any conflicting national or international event, or for any other reason. Should such a situation occur, PerryGolf will endeavour to book a course of comparable standard, and all booked guests will be notified of the change and replacement venue at the earliest opportunity.

Golf Handicaps: The golf courses we play around the world offer varying challenges. Players often require to be of a certain standard to properly and fully experience them in the company of likeminded fellow golfers. We therefore set a maximum permitted golf handicap to participate on our tours and cruises; The maximums are 28 for men and 36 for ladies.

Air Travel: Airline tickets for travel on scheduled airlines, if they should be issued for you by PerryGolf, are a separate item out with the travel package, and may carry change and cancellation penalties as specified by the carrier.

Transport by aircraft, rail, ship or coach: depends on the conditions of carriage of the relevant carrier. These conditions of carriage may limit or exclude the carrier’s liability to you under international law (such as the Warsaw Convention). The responsibility and liability of the specified air carriers respecting their performance of air transportation services are limited by and subject to the conditions of contract in the passenger ticket, the rules contained in tariffs on file with U.S. Department of Transportation (available for inspection on request), and applicable provisions of law and treaty.

Cancellation by PerryGolf: PerryGolf reserves the right to cancel a tour or package if circumstances so require. In the event of such, PerryGolf will make at its discretion, either a refund to travelers of all payments received in respect of the tour less any non-refundable deposits paid in advance to any supplier, or provide a future travel credit for the same value enhanced by any agreement reached with suppliers holding non-refundable deposits.. Such a refund of payments or future travel credit will be the full extent of PerryGolf’s obligation and liability to travelers and specifically excludes any fees or penalties suffered for any airline, transport, golf, accommodation as a result of the cancellation. This Agreement shall be governed by the substantive laws of the State of North Carolina. The parties irrevocably agree that any judicial proceedings relating to this agreement will be filed in a court of competent jurisdiction within New Hanover County, North Carolina.

Required Mobility & Fitness: Aspects of PerryGolf trips may require a certain level of fitness and mobility in order for a guest to participate fully. Activities may include walking over uneven or rough surfaces, stepping on/off buses, walking up/down stairways where elevators do not exist, stepping in/out of tender boats or occasionally smaller boats, this list is intended as representative but is not exhaustive. If a guest has any concerns over their fitness or mobility levels they should discuss this in advance of any trip with a PerryGolf golf travel expert and they will provide further information with regard to the activities that you are concerned about, but in general, PerryGolf activities are not designed or intended to be overly strenuous. Ultimately, guests themselves are the only people who can fully assess their capability to manage any of the activities offered, and so once booked, PerryGolf will not offer any refund or accept liability for any guest who is subsequently unable to participate (or may be prohibited from participating by any third party operator or any other relevant authority) in any activity, included or otherwise, due to their limited fitness or mobility levels.

Class Action Waiver: Our Conditions of Business and the contents of our reservation forms together provide for the exclusive resolution of disputes through individual legal action on your own behalf instead of through any class or representative action. You agree, even if the applicable law provides otherwise, that any lawsuit against us whatsoever shall be litigated by you individually and not as a member of any class or as part of a class or representative action, and you expressly agree to waive any law entitling you to participate in a class action.

Brochure Accuracy: As far as is known all information in the promotional and other materials of the Company is accurate at the time of publication. Changes cannot be made after publication date, and the Company accept no responsibility for any omissions or errors. Where they become aware of errors which could materially affect your travel package, they will take all reasonable steps to inform you in a timely manner.

Caddies & Golf Carts: PerryGolf includes golf carts or caddies (exclusive of gratuity) subject to their availability, and as specified on each program. If for any reason, they are unable to be provided, no compensation is payable.

Cruise Booking: Your cruise booking is a separate transaction, and governed by the Terms & Conditions of Azamara Cruise Lines

Travel Insurance in association with Allianz Global Assistance:
Working in conjunction with Allianz Global Assistance, PerryGolf offers Travel Protection to guests, which we believe meets the needs and expectations of today’s discerning International leisure traveler. This Travel Protection plan may be purchased at any time, although we recommend to purchase within 14 days of your initial deposit payment to ensure full benefits are applied.
